Terms of service

These Terms of Service apply to every visit to premiertents.com and every purchase from Premier Tents of Bellingham, Washington. By using the site or placing an order, you agree to them.

1. Who we are and what these terms cover

Premier Tents ("Premier Tents," "we," "us") is a family-owned business in Bellingham, Washington, that sells commercial canopies, sidewalls, leg drapes, bags and cases, replacement parts, and custom-printed tops and graphics. These terms cover purchases made on premiertents.com, by phone, by email, or through a quote. They also cover custom printing orders and event structure services.

If you are buying for a business, school, team or organization, you confirm that you have authority to bind it to these terms. These terms work together with our Shipping & Returns page. If the two conflict, the Shipping & Returns page controls for returns and shipping damage.

2. Orders, pricing and payment

An order is an offer to buy. It becomes a sale when we confirm it, and we may decline or cancel any order, for example because of a pricing error, a stock shortage, or suspected fraud. If we cancel a paid order, we refund the full amount.

Prices are in U.S. dollars and can change without notice. The price shown when you check out is the price you pay. Prices do not include shipping or sales tax, which we add where the law requires it.

Payment is due at checkout unless we have agreed to other terms in writing, such as a deposit on a custom or quoted order. You confirm that you are authorized to use the payment method you provide. Quoted prices stay valid for the period stated on the quote, and for 30 days if none is stated.

Product photos and colors are for reference. Screens vary, so slight differences from the product you receive are normal.

3. Shipping, delivery and damage claims

We ship from Bellingham, Washington. Shipping charges and estimated delivery times are shown at checkout or on your quote. Estimates are not guarantees, and we are not liable for delays caused by carriers, weather or events outside our control. Custom-printed items take longer to produce than stock items, and the lead time is confirmed when you approve your proof.

Risk of loss passes to you when the carrier takes the package from us. Please inspect every delivery. If an order arrives damaged, notify us immediately, keep all packaging, and take photos of the box and the product. We will work with you to replace the damaged merchandise.

You are responsible for providing a correct and complete shipping address. We are not responsible for orders lost or returned because of an address error.

4. Returns and refunds

Every return needs a Returned Goods Authorization (RGA) number before you ship anything back. Call or email us to get one. We cannot accept returns without it.

  • Packaging. Return items in their original packaging.
  • Non-defective returns. Items must be unused. You pay return shipping, and a 25% restocking fee applies.
  • Used merchandise. We do not give credit or refunds for used merchandise.
  • Defective items. Call us first for an RGA number, then return the item with a copy of your invoice and tell us whether you want a replacement or a refund. Return shipping and the restocking fee do not apply.

Custom-printed items are made to your order and cannot be returned unless they are defective or we printed them differently from the proof you approved (see section 5).

5. Custom printed orders

Custom tops, sidewalls, table covers and flags are printed by dye-sublimation, working with our design partner Liet Unlimited of Bellingham. Here is how an order works.

  1. You choose a product and send your artwork through our quote form or by contacting us.
  2. A designer lays out your artwork and builds a proof. Standard layout and art prep is included. From-scratch artwork, photo compositions and larger design projects are quoted separately.
  3. You review the proof and may request revisions. Nothing is printed until you approve the proof.
  4. After approval, we print, build and ship your order.

You are responsible for checking every detail of the proof, including spelling, phone numbers, URLs, colors, logo placement and print size. Once you approve a proof, we print it as shown. Final print quality depends on the artwork you supply, and we will tell you before printing if something will not reproduce well. Because dye-sublimation colors can shift slightly between screens and fabric, small color variations are normal.

Custom orders cannot be canceled or returned after printing starts. If we print an item differently from the proof you approved, or it arrives defective, we will correct it under section 4.

6. Safe use of canopies and tents

A pop-up canopy is a temporary shade structure. It is not a building, and it is not designed to withstand storms. Wind can lift an unsecured canopy and cause serious injury or damage. You are responsible for setting up and using our products safely.

  • Anchor every canopy. Secure each leg with weights, stakes or other anchoring suited to the surface, every time, even on calm days. Sidewalls and printed tops catch more wind and need more anchoring.
  • Watch the weather. Take the canopy down, or at minimum remove sidewalls and tops, before high wind, thunderstorms or heavy rain. Do not use it under snow load.
  • Stay clear of hazards. Keep canopies away from power lines, open flames, heaters and cooking equipment. Do not attach heavy items to the frame or use it to support anything.
  • Set up properly. Follow the set-up instructions, use enough people to raise the frame, and keep hands clear of the scissor mechanism.
  • Check your equipment. Inspect the frame, fabric and hardware before each use, and stop using damaged or worn parts.

Fire and water resistance ratings, where a product has one, apply only to the product as sold and under normal conditions. They do not make a product fireproof or waterproof. You are responsible for meeting any permit, fire marshal or venue rules for your event.

7. Warranty

We stand behind what we sell. If you receive a defective item, section 4 explains how to get a replacement or refund. [Warranty terms to confirm: coverage period, what is covered (frame, top, hardware, print), and what is excluded.]

A warranty does not cover damage from wind, weather, improper anchoring, misuse, normal wear, fading from long sun exposure, or unauthorized modification or repair. Any warranty we publish on the Warranty page is the only warranty we give, and it replaces all other warranties to the extent the law allows.

8. Artwork and intellectual property

When you send us artwork, logos, photos or text for printing, you confirm that you own them or have permission to use them, and that printing them will not infringe anyone's rights. You give us permission to reproduce your materials as needed to fill your order. We will not print content that is unlawful, infringing, hateful or deceptive, and we may refuse or cancel an order for that reason.

You agree to defend and reimburse us for claims that arise from artwork you supply.

We may show photos of finished custom orders in our portfolio and marketing. Tell us in writing if you would rather we did not.

The Premier Tents name, logo, website content, product photos and designs belong to us or our licensors. You may not copy or reuse them without our written permission.

9. Quotes and event structures

We offer party tents, banners, barricades, fencing and crowd-control layouts for events, and we can give planning guidance. Each of these is priced by written quote. The quote sets out the items, quantities, dates, delivery, set-up and any deposit.

Our guidance is general advice. You, the event organizer, remain responsible for the final layout, permits, insurance, site conditions, crowd safety and compliance with local fire and safety rules. Unless the quote says we will set up or take down equipment, setup and teardown are your responsibility.

10. Using the website

You may use premiertents.com for lawful shopping and information. Do not interfere with the site or its security, scrape it in bulk, submit false orders, or use it to harm others. We try to keep product, price and stock information accurate, but errors happen, and we may correct them at any time.

How we collect and use your personal information is described in our Privacy Policy. If we link to third-party sites, such as our design partner, those sites have their own terms and we are not responsible for them.

11. Disclaimers and limits of liability

Except for the warranty described in section 7, products and services are provided "as is," and we disclaim all other warranties, including implied warranties of merchantability and fitness for a particular purpose, to the extent the law allows.

To the extent the law allows, Premier Tents is not liable for indirect, incidental, special or consequential damages. These include lost profits, lost sales, event cancellation costs and booth or vendor fees. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

We are not liable for injury or damage that results from a failure to anchor a canopy, from use in unsafe weather, or from using a product against the instructions in section 6. Nothing in these terms excludes liability that cannot be excluded by law, and some states do not allow certain limits, so parts of this section may not apply to you.

12. Governing law and disputes

Washington State law governs these terms and any dispute about them, without regard to conflict-of-law rules. Please contact us first so we can try to resolve the problem informally. If that fails, the state and federal courts located in Whatcom County, Washington have exclusive jurisdiction, and you consent to them. If any part of these terms is found unenforceable, the rest stays in effect.

13. Changes and contact

We may update these terms from time to time. The version posted on premiertents.com when you place an order applies to that order. Continuing to use the site after a change means you accept the updated terms.
